The Parker Defendants moved for summary judgment on all the claims against them (malicious prosecution for multiple claims in the underlying litigation, and conspiracy to commit malicious prosecution). The hearing was on December 30th, 2009, before the Honorable Judge John Q McShane, Judge of Minnesota District Court (Hennepin County).
In their brief, the Parker Defendants argued there is no evidence the earlier claims Boris Parker represented against me lacked probable cause. They cited comments posted by third parties on my website as justification for federal counterclaims Parker filed against me (on behalf of his client). They also argued there was no evidence Boris Parker conspired with his client in the earlier malicious prosecution against me.
I filed a Plaintiff's memo opposing summary judgment, which laid out evidence the earlier claims were based on a story known to be false, and lacked evidence to support probable cause, and/or were not legally tenable.
These positions were argued at the hearing on Dec. 30th., with Morgan Smith also present and requesting summary judgment in his favor as well. On January 29th, 2010, Judge McShane signed an order granting the defendant's motion for summary judgment:
